A landmark result. 78 years in the making.
Christys & Co LLC is proud to announce that our lawyer, Chloe Tofarides, working in cooperation with Leonidas Georgiou Law Office, has secured a landmark ruling before the Limassol District Court in a property case rooted in events dating back to 1948.
A transaction dating back nearly eight decades
In 1948, Anonyme Hellenic Company of Chemical Products and Manure (Anonimi Elliniki Etaireia Chimikon Proionton kai Lipasmaton) transferred, sold and assigned its entire mining and quarrying business in Cyprus, together with its operations, installations and immovable property, to Hellenic Mining Company Limited.
Although the transaction encompassed all the immovable property of Anonyme, 33 properties situated in the Limassol district had not been registered in the name of Hellenic Mining at the Land Registry. What may once have appeared to be an administrative detail remained unresolved for almost eight decades.
A resolution grounded in legal argument and historical evidence
Acting on behalf of Hellenic Mining Public Company Limited, Chloe Tofarides successfully argued that the legal requirements for specific performance had been satisfied.
The Court further accepted that it was fair and reasonable to order specific performance, taking into account that Hellenic Mining had maintained continuous possession of the properties since 1948, had paid all relevant dues and taxes, and had assumed the liabilities associated with the properties from the date of the agreement.
The defendants’ defence of laches was unsuccessful, and the Court held that the claim had been filed within the applicable limitation period under the Limitation of Actions Law.
On 5 October 2026, the Limassol District Court issued orders under Article 7 of the Sale of Immovable Property (Specific Performance) Law, Law 81(I)/2011, directing the completion of the outstanding transfers in respect of all 33 properties.
Notably, some of the properties had not been registered in the name of Anonyme Hellenic Company of Chemical Products and Manure at the time of the 1948 agreement, adding a further layer of complexity to the proceedings.
The ruling addresses a matter originating before the establishment of the Republic of Cyprus, bringing a long-standing property dispute closer to resolution.
This outcome reflects the strength of the legal arguments advanced, the meticulous preparation required and the work involved in resolving a complex property matter spanning nearly eight decades.
We are immensely proud of Chloe Tofarides and the work she undertook to achieve this result, as well as the cooperation with Leonidas Georgiou Law Office throughout the proceedings.
A significant milestone for our client and a testament to the value of sustained, dedicated legal work.
